RaiseFutures Terms of Service

1. Agreement to These Terms

These Terms of Service ("Terms") are a legal agreement between you and DUCKYBANK LLC doing business as RaiseFutures ("RaiseFutures," "we," "us," or "our").

These Terms govern your access to and use of RaiseFutures websites, applications, campaign pages, dashboards, communications, content, tools, and related services collectively referred to as the "Services."

By accessing or using the Services, creating an account, participating in a campaign, or making a contribution through the Services, you agree to these Terms and our Privacy Policy.

If you do not agree, do not use the Services.

2. RaiseFutures and Raise Futures Foundation

RaiseFutures and Raise Futures Foundation ("Foundation") are separate organizations with different roles.

RaiseFutures is the technology and operating company. RaiseFutures provides and manages the platform, campaign systems, participant experience, communications, data infrastructure, program execution tools, and reporting services.

Raise Futures Foundation is a separate nonprofit organization that may participate in certain programs, including by receiving or authorizing charitable funds, supporting financial education and community-development programming, and overseeing charitable program purposes.

The specific organization receiving a payment or donation will be identified through the applicable transaction, campaign, receipt, or program documentation.

3. The Services

RaiseFutures provides tools and services that may include:

  • School fundraising campaigns
  • Individual campaign and participant pages
  • Family and donor engagement tools
  • Financial literacy activities and resources
  • Child savings education and account guidance
  • Savings activation tools
  • Campaign incentives and matched savings programs
  • Community partner and volunteer engagement
  • Bank and financial institution partnerships
  • Campaign communications
  • Impact measurement and reporting
  • Post-campaign gifting and contribution tools

Features may change as the Services develop.

RaiseFutures does not guarantee that every feature will be available for every campaign, school, user, or geographic area.

4. Eligibility and Adult Use

You must be at least 18 years old and legally capable of entering into a binding agreement to create a RaiseFutures account or act as the responsible party for a child.

The Services may include experiences intended to benefit or engage children, but accounts and financial decisions must be managed by an authorized adult unless RaiseFutures expressly provides otherwise.

Children may participate in classroom activities and campaign experiences under the supervision of schools, parents, guardians, or other responsible adults.

5. Accounts and Account Security

Certain Services require an account.

You agree to provide accurate, complete, and current information and to update it when necessary.

You may not:

  • Impersonate another person
  • Create an account using information you are not authorized to use
  • Share credentials in a way that compromises account security
  • Attempt to gain unauthorized access to another user's account or campaign

You are responsible for activity conducted through your account unless you promptly notify us of unauthorized use.

Contact hello@raisefutures.org if you believe your account has been compromised.

6. Child Profiles and Campaign Enrollment

RaiseFutures may allow an adult to create or activate a campaign profile for a child.

By creating or managing a child profile, you represent that you are the child's parent, legal guardian, or another person legally authorized to act on the child's behalf for the relevant purpose.

You agree that information you submit about the child is accurate and that you have the authority to provide it.

A child's last name and photograph are optional. Parents and guardians control what information appears on a public campaign page. By default, only a child's first name or nickname is displayed.

Campaign access codes, enrollment links, teacher information, school information, and similar tools are intended to help connect authorized families to the appropriate campaign. You may not use these tools to create profiles for children for whom you are not authorized to act.

RaiseFutures may suspend a profile or request additional verification if we reasonably believe a profile has been created without authorization.

7. Campaign Pages and Sharing

RaiseFutures campaign pages may be designed to be shared publicly with friends, family, and other potential supporters.

You are responsible for the information and content you choose to make available through a campaign page.

Do not post sensitive personal information, financial account numbers, medical information, home addresses, or other information that should remain private.

RaiseFutures may remove or limit content that violates these Terms, applicable law, school requirements, or the rights of others.

8. Donations, Contributions, and Payment Processing

RaiseFutures uses third-party payment providers to facilitate authorized transactions. Current service providers include Stripe. Stripe handles payment credentials under its own terms and privacy practices.

Payment credentials may be collected and processed directly by those providers and are subject to their terms and privacy policies.

RaiseFutures does not operate as a bank and does not offer users stored-value accounts or general-purpose money transmission services.

RaiseFutures does not intend to take custody of or pool user funds for its own account. Funds associated with charitable programs are processed, received, authorized, or disbursed through the Foundation, another identified nonprofit recipient, regulated payment providers, financial institutions, or other authorized recipients according to the applicable program structure.

RaiseFutures acts as a technology and service provider in connection with these activities.

The payment page or campaign materials will identify the relevant transaction and, where applicable, how funds are intended to be used or allocated.

You authorize the applicable payment provider and recipient organization to process the transaction you initiate.

9. Charitable Contributions

Some payments made through the Services may be charitable contributions to Raise Futures Foundation or another nonprofit organization.

Other transactions may not be charitable contributions.

The charitable receipt identifies the amount, if any, treated by the receiving nonprofit as a charitable contribution. RaiseFutures does not provide tax advice. You should consult your own tax adviser regarding deductibility.

The tax treatment of a transaction depends on the recipient, structure, applicable law, and your individual circumstances.

10. Campaign Allocations and Program Benefits

A RaiseFutures campaign may support multiple forms of impact, including school funding, program delivery, financial education, savings incentives, or other activities described in the campaign.

Any campaign allocation or incentive rules will be described through campaign materials or applicable program documentation.

Savings matches, incentives, rewards, or similar benefits may be subject to eligibility requirements, available funding, campaign deadlines, account setup requirements, verification requirements, or other conditions.

Unless expressly stated otherwise, an incentive is not guaranteed until applicable requirements have been satisfied and the benefit has been authorized for disbursement.

RaiseFutures may verify eligibility and track program activity on behalf of the Foundation or another program provider.

11. Fees

RaiseFutures may charge platform, program, service, or other fees in connection with certain Services.

Third-party payment processors may also charge processing fees.

Applicable fees will be disclosed before you complete a transaction or otherwise agree to the applicable paid Service.

Fees and pricing may change for future transactions or campaigns.

12. Refunds, Disputes, and Chargebacks

Refund availability depends on the type of transaction, the recipient organization, applicable campaign rules, payment-provider requirements, and applicable law.

Transactions may be reversed, disputed, or refunded through the applicable payment processor and recipient organization. Completed charitable contributions may have limited refund availability.

Any specific refund policy presented during checkout or in connection with a campaign is incorporated into these Terms for that transaction.

Processing fees, platform fees, service fees, or other charges may be treated differently from the underlying contribution where permitted by law and as disclosed in the applicable refund policy.

13. Child Savings Accounts and Financial Information

RaiseFutures may provide educational information about financial accounts that families may consider for children, including savings accounts, custodial accounts, education savings accounts, investment accounts, or other financial products.

RaiseFutures may also provide questionnaires, comparisons, recommendations, links, or account-opening pathways intended to make it easier for families to understand available options.

These materials are provided for educational and informational purposes.

RaiseFutures is not a bank, broker-dealer, registered investment adviser, accountant, tax adviser, or financial planner.

Information provided through the Services does not constitute individualized investment, legal, accounting, or tax advice.

You are responsible for evaluating which account or financial product is appropriate for your family.

14. Third-Party Financial Institutions and Offers

RaiseFutures may present information or offers from banks, financial institutions, account providers, community partners, or other third parties.

A third party may offer an incentive such as a new-account bonus or other benefit.

Unless expressly stated otherwise:

  • RaiseFutures does not issue or maintain the financial product
  • The third party determines eligibility and account terms
  • Opening an account creates a relationship between you and the third party
  • The third party's terms and privacy policy apply
  • RaiseFutures does not guarantee approval, rates, bonuses, returns, features, or continued availability

RaiseFutures may receive compensation or program support from certain partners. Where appropriate, sponsored or partner-supported offers may be identified as such.

A partner relationship does not mean that a particular account is necessarily the best option for every family.

15. Communications

By providing your email address or other contact information, you agree that RaiseFutures may send operational communications necessary to provide the Services you request, including account notices, campaign information, transaction information, security notices, and customer-support communications. Operational communications may continue when reasonably necessary to provide the Services, even if you have unsubscribed from promotional communications.

Where required, we will obtain separate consent for marketing or promotional communications.

You may unsubscribe from promotional email using the unsubscribe link provided in the message.

16. RaiseFutures Text Messaging Programs

RaiseFutures operates two separate text-messaging programs described below. Your consent to one program does not enroll you in the other.

Parent / Account Messaging

RaiseFutures may offer an SMS or MMS messaging program for campaign communications, reminders, account information, participant updates, customer support, and other communications you request.

By affirmatively opting in to the RaiseFutures messaging program, you consent to receive text messages at the mobile number you provide consistent with the consent presented when you enroll.

Message frequency varies based on campaign activity, your participation, and the Services you request. Message and data rates may apply.

Parent-Authorized Donor Outreach

A registered campaign participant may request that RaiseFutures send limited fundraising messages to individually selected friends and family on the participant's behalf. By submitting contact information and selecting Send, the participant represents that they personally know the contacts and reasonably believe the outreach is appropriate.

This program is capped at up to 3 messages per fundraiser per recipient, including the initial invitation. Campaign reminders stop for a recipient who has already donated. Recipient phone numbers are not used for general RaiseFutures marketing, other fundraisers, YoorKids, bank partners, financial products, or any unrelated purpose without the recipient's separate consent.

General SMS Rules (Both Programs)

Consent to receive promotional text messages is not a condition of making a donation, participating in a RaiseFutures fundraiser, or purchasing a service.

To opt out, reply STOP to any RaiseFutures text message.

You may receive a final confirmation message after opting out.

For help, reply HELP or contact hello@raisefutures.org.

Your mobile carrier is not liable for delayed or undelivered messages.

Your consent applies only to the messaging program for which it was collected and is not transferable to another company, bank, school, nonprofit, sponsor, or other organization.

Please review our Privacy Policy for information about how mobile information and SMS consent are handled.

17. Contacts and Outreach

Certain Services may allow parents, campaign participants, schools, or organizations to invite or communicate with other people.

You may only provide or use another person's email address, telephone number, or other contact information when you have the legal right to do so.

Parent-Authorized Donor Invitations

When you enter friends' or family members' contact information and request that RaiseFutures send fundraising messages on your behalf, you represent that:

  • You personally know each contact.
  • You reasonably believe they would welcome the invitation.
  • The contacts were not purchased, rented, scraped, or obtained deceptively.

RaiseFutures will send these contacts a limited series of messages about the specific fundraiser on your behalf — up to 3 messages per fundraiser, including the initial invitation. Recipients may opt out at any time. Their contact information is not used for general RaiseFutures marketing, other fundraisers, or any unrelated purpose without the recipient's separate consent.

General Contact Rules

You may not use:

  • Purchased contact lists
  • Rented contact lists
  • Scraped telephone numbers or email addresses
  • Contact information obtained deceptively or without required permission

RaiseFutures may limit or suspend communication features where we believe they are being misused.

18. School, Organization, and Campaign Administrator Responsibilities

If you use the Services on behalf of a school, nonprofit, business, bank, or other organization, you represent that you are authorized to act for that organization.

Participating organizations are responsible for:

  • Providing accurate organizational information
  • Complying with applicable laws and internal policies
  • Using participant information only for authorized purposes
  • Protecting access credentials and campaign information
  • Cooperating with reasonable compliance and fraud-prevention procedures
  • Following applicable campaign, payment, and program rules

Organizations may not use RaiseFutures participant information for unrelated solicitation or marketing without appropriate consent.

19. User Content

You may be permitted to upload photographs, messages, testimonials, comments, videos, or other materials ("User Content").

You retain ownership of your User Content.

By submitting User Content through the Services, you grant RaiseFutures a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, format, and use that content as reasonably necessary to provide and operate the Services.

You represent that you have the rights and permissions necessary to submit the content.

Identifiable photographs, testimonials, or stories involving children will not be used by RaiseFutures for public advertising or promotional purposes solely because they were submitted to the platform. Appropriate additional consent will be obtained where required for such use.

20. Prohibited Uses

You may not use the Services to:

  • Violate applicable law
  • Commit fraud or misrepresentation
  • Create an unauthorized child profile
  • Impersonate another person or organization
  • Conduct money laundering or sanctions violations
  • Use RaiseFutures as an unauthorized payment-processing or money-transmission service
  • Circumvent payment, campaign, security, or eligibility controls
  • Send unlawful or unauthorized messages
  • Harvest or scrape personal information
  • Upload malware or interfere with the operation of the Services
  • Access another person's account without permission
  • Publish content that infringes intellectual property, privacy, or other legal rights
  • Engage in harassment, threats, exploitation, or unlawful discrimination
  • Misrepresent a campaign, organization, donation, or program
  • Use the Services for gambling, illegal raffles, illegal sweepstakes, prohibited financial schemes, or other unlawful activity

We may investigate suspected misuse and cooperate with payment providers, schools, financial institutions, regulators, and law enforcement where appropriate.

21. Intellectual Property

The Services, including RaiseFutures software, design, text, graphics, logos, campaign systems, educational materials, reporting tools, and other content created by RaiseFutures are owned by RaiseFutures or its licensors and are protected by applicable intellectual-property laws.

Subject to these Terms, RaiseFutures grants you a limited, revocable, non-exclusive, non-transferable right to use the Services for their intended purpose.

You may not copy, reproduce, reverse engineer, resell, commercially exploit, or create derivative works from the Services except as permitted by law or with our written permission.

22. Third-Party Services

The Services may depend upon or link to third-party services, including payment processors, financial institutions, communications providers, analytics providers, and other platforms.

RaiseFutures does not control those third-party services.

Your use of a third-party service may be subject to separate terms and privacy policies.

23. Suspension and Termination

RaiseFutures may restrict, suspend, or terminate access to all or part of the Services if we reasonably believe:

  • You violated these Terms
  • Your activity presents a security, fraud, legal, or reputational risk
  • Your account or campaign is unauthorized
  • A payment provider, school, Foundation, financial institution, regulator, or other authorized party requires action
  • Suspension is reasonably necessary to protect users or the Services

You may stop using the Services at any time.

Certain provisions of these Terms that by their nature should survive termination will remain in effect.

24. Changes and Availability

We may modify, add, suspend, or discontinue features of the Services.

We do not guarantee that the Services will always be available without interruption or error.

We may perform maintenance, address security issues, or make changes necessary to comply with legal, payment-provider, carrier, or partner requirements.

25. Disclaimer of Warranties

To the fullest extent permitted by law, the Services are provided on an "as is" and "as available" basis.

RaiseFutures does not warrant that:

  • The Services will always be uninterrupted or error free
  • A fundraiser will achieve any particular financial result
  • A family will qualify for a particular financial product or incentive
  • A financial product will produce any particular return
  • Every communication will be delivered
  • Information supplied by third parties will always be accurate or current

Some jurisdictions do not permit certain warranty exclusions, so portions of this section may not apply to you.

26. Limitation of Liability

To the fullest extent permitted by applicable law, RaiseFutures and its officers, directors, employees, contractors, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, lost opportunities, or similar losses arising from or relating to the Services.

To the fullest extent permitted by law, RaiseFutures' total liability arising out of or relating to the Services or these Terms will not exceed the greater of:

  1. The amount you paid directly to RaiseFutures during the six months immediately preceding the event giving rise to the claim, or
  2. $100.

These limitations do not apply where prohibited by law.

27. Indemnification

If you operate a campaign, act on behalf of an organization, provide unauthorized content or contact information, or misuse the Services, you agree to defend, indemnify, and hold harmless RaiseFutures and its officers, directors, employees, contractors, and affiliates from claims, losses, liabilities, damages, costs, and reasonable attorneys' fees arising from:

  • Your violation of these Terms
  • Your unlawful use of the Services
  • Your User Content
  • Your violation of another person's rights
  • Contact information or communications you provide or initiate without required authorization
  • Your fraud, misconduct, or misrepresentation

This section applies only to the extent permitted by applicable law.

28. Governing Law and Venue

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.

Unless applicable law requires otherwise, any dispute arising from these Terms or the Services will be brought in a state or federal court with jurisdiction in Tarrant County, Texas, and you consent to that jurisdiction and venue.

29. Changes to These Terms

We may update these Terms from time to time.

Material changes may be communicated through the Services, email, or another appropriate method.

Your continued use of the Services after revised Terms become effective constitutes acceptance of the revised Terms to the extent permitted by law.

30. Miscellaneous

These Terms and the Privacy Policy constitute the agreement between you and RaiseFutures regarding the Services unless a separate written agreement applies.

If a provision of these Terms is found unenforceable, the remaining provisions remain effective.

Our failure to enforce a provision is not a waiver of our right to enforce it later.

You may not assign your rights under these Terms without our consent. RaiseFutures may assign these Terms in connection with a merger, acquisition, restructuring, or sale of substantially all relevant assets, subject to applicable law.
